Cassation: “Giving a fag is defamation”

It is not true that the term “fagot” no longer has an offensive value, this term is harmful to the personality of the person to whom it is addressed. This was established in a sentence by the Court of Cassation, rejecting the appeal of a transsexual defendant convicted on appeal for having claimed on Facebook the alleged homosexuality of a man, with whom he would have had a sexual relationship, calling him “fagot” and “disgusting” . According to what Studio Cataldi points out, reporting the sentence of the Supreme Court, it is not true, as the defendant’s defense argues, that calling a ‘fagot’ to a person on the Facebook wall does not integrate the crime of defamation because now this term is not more used in a derogatory sense: the term must be considered offensive and harmful to the personality of the person to whom it is addressed.The Supreme Court therefore confirmed the conviction for defamation of the transsexual who had addressed this epithet to the man with whom he would have had paid relationships.
