If they wanted to take Fica into custody, they would need the approval of the National Council. According to the Constitution, the Mandate and Immunity Committee decides on the consent to the detention of a Member if he / she has been “caught and detained in a criminal offense”. The coalition has a majority in the parliament’s mandate and immunity committee, chaired by OĽaNO MP Anna Andrejuvová. She told the daily N that the parliament had not yet received a request to detain him. However, according to the Prosecutor’s Office Act, such a request would have to be sent by Attorney General Maroš Žilinka. “The Attorney General asks the National Council to give its consent to the arrest of a member of the National Council; the President of the National Council shall notify the President of the National Council of the request for the issuance of the consent to take the Member of the National Council into custody, ”the law states. Parliament’s Deputy Speaker Gábor Grendel (OĽaNO) says that according to the Constitution, there has been no reason to contact the police or the prosecutor’s office so far, and consent is required when caught in a criminal offense – and in this case it is probably a past act. Parliament’s consent would be required in the case of a motion for detention for a Member. They have never detained such high-ranking politicians. Police President Štefan Hamran announced last week that investigators are also approaching political leaders.
