One week after the head of the LSN, Marian Kotleba, was convicted of sympathy for neo-Nazism, he declared that he had not lost his mandate and would continue to exercise it. At the same time, the Constitution makes it clear that a person who has committed an intentional crime is losing his or her seat in the National Council. At the same time, it states that the mandate expires even if “he was convicted of a criminal offense and the court did not decide in his case on a suspended sentence”. MP Kotleba also claims that the court failed to do so, and since he did not go to prison, voters will see him sitting in plenary at the next meeting. “If the sentence is suspended, the effect of the sentence in the form of loss of the deputy’s mandate does not occur, the mandate does not fall, so the deputy remains,” Kotleba argues. However, experts agree that this will not work, because the Senate of the Supreme Court, led by Pavel Farkaš, stated in the verdict that the head of the people acted “with direct intentions” when expressing sympathy for neo-Nazism.
