The Trenčín District Court will deal with the proposal for parole at a public hearing on 15 November convicted Ladislav Bašternák from prison. The conditional release was proposed by the director of the Institute for the execution of a custodial sentence in Dubnice nad Váhom, where Bašternák is serving his sentence. Roman Tarabus, a spokesman for the Trenčín Regional Court, informed about it.

Such a procedure is permitted by the Criminal Procedure Code if a person convicted of a crime has already served half his sentence. Tarabus recalled that a court may conditionally release a convicted person from serving a custodial sentence if three legal conditions are met at the same time. The first condition is formal, namely that the convicted person must serve such part of the sentence imposed as provided by law.

The second condition is that the convicted person proves his improvement in the conduct and performance of his duties in the execution of a custodial sentence. “In order to examine the fulfillment of this condition, the court is used to evaluate the convicted person from serving a custodial sentence and from serving a custodial sentence. Finally, the court assesses the fulfillment of the third condition, ie whether the convicted person can be expected to lead a proper life in the future. It is basically a statement based on an assessment of all the essential facts concerning the convict, “Tarabus explained.

When deciding on parole, the court also takes into account the nature of the crime committed and the institution in which the sentenced sentence is served.
In March 2019, Bašternák was sentenced by a three-member senate of the Regional Court of Appeal in Bratislava to an unconditional five-year prison sentence in a case of non-payment of taxes and insurance premiums. At the same time, Bašternák lost property to the state, as he caused considerable damage.
