The director of the Dubnica prison proposed the conditional release of Ladislav Bašternák. The District Court in Trenčín will decide on this on 15 November. The court may decide on conditional release after serving a sentence only on the proposal of the director of the prison where he is serving the sentenced sentence.

Bašternák was convicted by the District Court in Bratislava II and subsequently in March 2019 by the Regional Court in Bratislava for failure to pay the tax on a five-year sentence and a forfeiture sentence.

He was serving his sentence in Dubnice nad Váhom, which is a prison with a minimum degree of guarding. The director of this prison is Dušan Bartoš.

As a spokesman for the Trenčín court added, the director of the Dubnica prison proposed that the Bašternák be released on parole, but with an ordered inspection by technical means. He should therefore have a monitoring device after his release.

The court may decide on dismissal if all three legal conditions are met at the same time. The first is that he must have served part of the sentence imposed, as provided by law. He must show an improvement in his conduct and in the performance of his duties in the execution of a custodial sentence. The third condition is to assess whether the convicted person can be expected to lead a proper life in the future.

When deciding on parole, the court also takes into account the nature of the crime committed and the institution in which the sentenced sentence is served, the spokesman of the court added.
