TRENČÍN. The Trenčín District Court will deal with a motion for the conditional release of convicted Ladislav Bašternák from imprisonment on 15 November at a public hearing.

The conditional release of a convict with an ordered control by technical means was proposed by the director of the Institute for the Execution of Sentences of Imprisonment in Dubnice nad Váhom, where the convict is serving his sentence.

Roman Tarabus, a spokesman for the Regional Court in Trenčín, informed about it.

According to Tarabus, such a procedure is permitted by the Criminal Procedure Code, according to which the court decides on the conditional release from imprisonment of a person convicted of a crime after serving half of it only on the proposal of the director of the custodial institution or the director of the custodial institution. performs.

“The court may release the convicted person conditionally from serving a custodial sentence if three legal conditions are met at the same time. The first condition is formal – the convict must perform such part of the sentence as provided by law. The second condition is that the convicted person proves his improvement in the conduct and performance of his duties in the execution of a custodial sentence. The court assesses the fulfillment of the third condition, ie whether the convicted person can be expected to lead a proper life in the future, “said Tarabus.

He added that when deciding on parole, the court also takes into account the nature of the crime committed and the institution in which the sentenced sentence is served.

Entrepreneur Bašternák was found guilty of the crime of failure to abduct days and premiums, and the court sentenced him to five years’ imprisonment. He took office on March 15, 2019.
