The indictment was based on photos shared by the group on the WhatsApp social network, which depict family members celebrating Adolf Hitler’s 128th birthday – they bought a cake with a swastika, shot a Nazi flag on the table and drank wine with a Hitler label.

The defendants claim that it was a joke

The three defendants – two brothers and their uncle – confessed to organizing a “Nazi” celebration. Nevertheless, they claimed that they were not followers of Hitler and that it was just a joke. They were sentenced to 21, 18 and 14 months in prison on probation. The fourth defendant – the mother of a couple of brothers – was given a 12-month condition.

The investigation started in 2011

The investigation of the case dates back to 2011, when house searches were also carried out. Until May 2018, one of the defendants – the then local politician of the right-wing populist Free Party of Austria (FPÖ) – used license plates with Nazi numerical symbols on two passenger cars.

In addition, he is accused of outrageing that he published a post on Facebook in 2018 claiming that Islam had claimed the most casualties compared to German National Socialism, Stalinist Communism and Chinese Maoism.

News supporting the ideas of nationalism

One of the accused admitted that he sent messages on the social network supporting the ideas of Nazism. According to the prosecutor’s office, it was, for example, a picture of a woman with a tattoo in the form of an imperial eagle or St. Nicholas with a cap with an imperial eagle motif and a swastika on his shoulder. Another image depicted Hitler with an anti-Jewish slogan facilitating the Holocaust.
