Of the ten defendants for whom the prosecutor requested custody, Judge of the Specialized Criminal Court Peter Pulman sent six into custody. Zuzana Plačková, her husband René Strausz, Lukáš Masaryk and Marek Cibulka are prosecuted at large. The prosecutor filed a complaint in the case of Plačková and her husband, so the final verdict will be announced by the Supreme Court. He set the proceedings on October 7.

In the case of the four defendants who remained at large, Judge Pulman saw no reason to prosecute and considered the charges unfounded. This follows from an anonymised resolution that we obtained following a request for free access to information.

Honest person and motivator

The judge heard all the accused in a closed session on Wednesday. Since there were many, they were divided into two groups – five who were to sell meth and five who were to sell cocaine. Among the second group was also Plačková and her husband. It is clear from the resolution on the accusation that other accusations were made against them.

Peter Šoka, who eventually ended up in custody, was allegedly also influenced Plačková through drugs. However, Plačková and Strausz distanced themselves from drug use and sale. “I’m wronged because I have a high enough income and I’m not dependent on drugs to sell.” Plačková said before the judge, noting that her monthly income is between 100,000 and 200,000 euros. The judge agreed with the objections of the defense

In the preparatory proceedings, several witnesses were also heard, who convict the rest of the accused. According to the Pre-Trial Judge, it can be concluded that the six defendants who ended up in custody have a reasonable suspicion that the evidence adduced by the witnesses indicates that the act for which the prosecution was instituted was committed.

In addition to witness statements, the three accused also convicted eavesdropping and recording of telecommunications traffic. “It is also necessary to point out the results of home and other searches, which also indicate the commission of another crime,” the judge remarked. “However, this procedure of the preparatory proceedings does not mean illegality, as the defense points out, and it is no longer possible to conclude from it on the unfoundedness of the criminal prosecution and, in that sense, the absence of material conditions of detention.” Pulman added.

Introduction to a better society

In Plačková’s and Strausz’s case, the judge states that they are convicted by another defendant’s testimony, “being heard” in the sense that another accused should have boasted to him that Plačková and Strausz are his ticket to a higher society for the sale of cocaine and methamphetamine .

He added that none of these defendants had evidence of the crime they were accused of.

“The pre-trial judge then states that it is not possible to conclude from the evidence obtained so far in the case of these accused persons that the findings indicate that the act for which the prosecution was instituted has the characteristics of a criminal offense and the reasons on suspicion that this act was committed by the accused Masaryk, Cibulka, Strausz and Plačková, ” the judge added.

The prosecutor filed a complaint

Immediately after the verdict was handed down, the prosecutor filed a complaint. The Supreme Court will thus decide on Plačková and Strausz on October 7 at 1 p.m. Whether or not to finally land in custody is decided later.
