The representative of the Supreme Court will not be in Heger’s working group – PRAVDA.sk

The President of the Supreme Court, Ján Šikuta, came to the conclusion that the Supreme Court would not send a representative to the working group “For the Restoration of Confidence in the Rule of Law”.

Heger announced the creation of the working group last week. In addition to representatives of the General and Special Prosecutor’s Offices, a representative of the Supreme Court of the Slovak Republic was to work in it.

According to Šikut, however, the participation of the nominee of the Supreme Court “carries considerable risks.” “The exercise of judicial power must take place in such a way that the requirement of its independence and impartiality is maintained at all times, not only on a subjective level but also on an objective one, externally. It can be expected that the Supreme Court will once decide all criminal cases monitored by the public, in which there was, resp. an indictment will be filed. Many detention matters are also decided on it on an ongoing basis. The Supreme Court must manage these matters not only legally, but also communicatively to the public, “Šikuta responded to the offer from the Prime Minister.

Wanting the Supreme Court to be able to decide all matters fairly and lawfully, Shikuta considers it better “to avoid anything that could provide even the slightest pretext for questioning the independence and impartiality of the Supreme Court and its individual judges.” Therefore, the Supreme Court will not send its representative to the working group of the Security Council.
