François Molins: “Covid complaints arrive by the thousands” – LCI

Their treatment heralds a new chapter in the conflicting relationship between justice and politics. The searches ordered by the Court of Justice of the Republic (CJR), at Olivier Véran in particular, had provoked heated controversy.

Guest of “Darius Rochebin 8 PM”, in a major interview broadcast on Sunday, François Molins reveals the extent of the legal actions initiated concerning the Covid: “There are thousands of complaints coming in. “ He specifies : “It is a phenomenon which is new, which is certainly due to the development of the modes of communication and the Internet, and which affects the Court of Justice of the Republic.”

As to how many will be admissible, the magistrate explains: “It is the complaints committee that will assess it. The same phenomenon occurs at the Paris public health center. (…) It is a phenomenon which concerns the problem as a whole: the common law aspect or the ministerial aspect. “

Regarding the ministers, the CJR had ordered, last October, searches of the offices and homes of Olivier Véran and Edouard Philippe in particular. The event had provoked strong reactions. Questioned on a risk of excess of power of the justice, which could parasitize the health action, François Molins answers: “The Court of Justice of the Republic performs the function for which it was created, to prosecute offenses alleged against ministers in the exercise of their function, even if it was in the context of political action. There are a number of reform plans for the CJR. If there is a problem there, the model has to evolve. It is the national will that must seize it. “

This chapter adds to the already strained relationship between the judiciary and past or current political leaders. Asked about the danger of a possible “megalomania” often criticized for judges and for the expression “methods of barbouzes”, formerly employed by Eric Dupond-Moretti to qualify the wiretapping of lawyers by the courts, François Molins reacts: “I do not lecture colleagues who did their work conscientiously and as they valued.” He believes, however, that it would be preferable in the future “to submit the examination of fadettes to the authorization of a judge.”
