After the suspension in several departments of the precious sesame to enter shopping centers, the Val d’Oise will not have the same outcome.

Wednesday September 1, 2021, administrative court of Cergy-Pontoise rejected the request against the prefect’s order requiring the presentation of the health pass in areas of more than 20,000 m2, ie eight department stores and shopping centers in Val-d’Oise *.

A hearing was held Monday, August 30 in court following a administrative appeal filed Thursday, August 26 by lawyer Yoann Sibille on behalf of the center E.Leclerc of Armpits and an inhabitant of Deuil-la-Barre. The latter explained that he was in difficulty to do his shopping and could no longer go to the Auchan supermarket in Sarcelles.

Attack on freedoms

Stressing that no development had been put in place to allow, as required by the legislator, access for people who do not have a health pass to shops offering essential goods and services within the shopping centers, the summary judge considered “that the contested decree clearly violated the fundamental freedoms of the freedom to conduct business and to come and go”.

However, the magistrate considered that the second condition of admissibility of the summary release, relating to urgency, was not fulfilled in this case. While he underlined the significant economic consequences of the contested decree for the applicant company, he recalled the epidemiological situation in the department of Val-d’Oise, “which remains degraded and worrying, with in particular an incidence rate in continuous increase since June 29, 2021 ”.

He therefore ruled that “the public interest in protecting public health and controlling the epidemic did not justify the urgency of the suspension measure requested”.
