Covid-19: in Paris, the health pass maintained in shopping centers – archyde

The request for the suspension of the prefectural decree imposing the health pass in large Parisian shopping centers was rejected by the Paris administrative court, we learned on Wednesday 1^er September. The requesting party “Does not establish that the decree which it challenges would prejudice in a sufficiently serious and immediate manner to its situation justifying an intervention of the judge in summary proceedings within forty-eight hours”, estimated the judge of the summary proceedings.

Not filling “Not the required emergency condition” by the courts, the request was therefore rejected. “The administrative court rejected the filed requests, considering in a very surprising way that there was no urgency to rule”, reacted one of the lawyers who filed an appeal, Yoann Sibille. “The basic issue relating to the legality of the prefectural decree was not at all dealt with by the court”, he further commented, announcing at the same time his intention to appeal this decision.

The Administrative Court of Versailles, the first to have suspended this type of decree, had for its part considered that these restrictions did not provide for“Arrangements to allow customers who do not have [d’un] past “ to access “Basic goods and services”. Other administrative tribunals – in particular those of Yvelines, from Essonne, Hauts-de-Seine or Haut-Rhin – had also decided to suspend similar orders, for the same reason.

Several centers concerned, including BHV and Le Bon Marché

Many prefects had indeed started, in mid-August, to impose the health pass in certain shopping centers. These measures were required by the government in the departments where the incidence rate exceeded 200 cases per 100,000 inhabitants over a week.

In Paris, many shopping centers are concerned, such as the BHV, Printemps Haussmann, the main building of Galeries Lafayette, Samaritaine, Le Bon Marché, Beaugrenelle and Italy 2.

The National Council of Shopping Centers (CNCC), the employers’ organization in the sector, mentions “A drop of a quarter in attendance in all shopping centers” compared to August 2019 due to the ” confusion “ caused by the restrictions on some of them. The CNCC – like Michel-Edouard Leclerc – calls for the removal of the health pass for shopping centers.
