The two lawyers of Versailles who obtained, this Tuesday, August 24, 2021, the suspension of the health pass in the shopping centers of Yvelines have decided to go further.

The day after the decision pronounced by the administrative court of Versailles, this Wednesday, August 25, 2021, they gave formal notice to all the prefects of Ile-de-France to adopt this case law. Namely those of Paris, Seine-et-Marne, Essonne, Hauts-de-Seine, Seine-Saint-Denis, Val-de-Marne and Val-d’Oise.

»Following the order issued by the Administrative Court of Versailles, I call on you to proceed immediately with the withdrawal of your decree extending the” sanitary pass “to shopping centers. Any maintenance will be the subject of legal action, particularly in terms of liability ”, notified Yoann Sibille and Tarek Koraitem.

“It is the law that I defend”

Contacted, the lawyer motivated this action.

“I don’t act out of personal ambition. It is the law that I am defending. And I am responding to many people who have asked me to lead such an action. “

For the time being, Yoann Sibille does not intend to attack the whole of France, probably counting on a national effect which could motivate colleagues from other bars.

As a reminder, the administrative court had challenged the order of the prefect of Yvelines on a simple principle. The summary judge considered that the freedom to come and go was not respected, the essential shops not being accessible to people without a health pass. We are talking about pharmacies or supermarkets.

For justice, the notion of a living area allowing shopping elsewhere was not sufficient to guarantee this freedom.

Paradoxically, that same day, the Toulouse administrative court considered that the notion of a living area was valid.

In the meantime, this Wednesday, August 25, the prefecture of Yvelines had not yet decided, either to appeal or to formulate a new decree imposing the health pass in shopping centers.

Since the evening before, the health pass is no longer requested in the 14 centers targeted, in the Yvelines.
