Nirvana faces lawsuit over album cover Nevermind – Aktuality.sk

The British news television BBC informed about it on its portal on Wednesday.

The photo shows a four-month-old Elden in the pool catching a dollar bill hanging on a fishing line in front of him. More than 30 million records of this famous album have been sold worldwide, featuring hits such as Smells Like Teen Spirit, Come As You Are and Lithium.

The parents never signed a disclosure agreement

Elden, 30, now claims that his parents never signed a release agreement that would allow his film to be used on the album.

He also alleges in the lawsuit that nude photography is equivalent to child pornography.

“The footage reveals an intimate part of Spencer’s body and obscenely exposes Spencer’s genitals from the time he was an infant to the present,” the lawsuit filed in a lawsuit filed in a U.S. state in California.

Non-sexualized photographs of young children are generally not considered pornography under United States law.

He suffered lifelong damage

The young man states that the consequence of the work of art is that he “has suffered and will continue to suffer lifelong harm”, including extreme and enduring emotional difficulties. The work also affected his normal development and progress in education and required medical and psychological treatment.

Elden is seeking damages of at least $ 150,000 from each of the 15 defendants, including living members of the group Dave Grohl and Krist Novoselic, the administrator of the estate after Kurt Cobain, Cobain’s former wife Courtney Love and photographer Kirk Weddle.

They have not yet commented on the lawsuit

Representatives of Nirvana and their record companies have not yet commented on the lawsuit.

Elden reworked the album cover several times, both as a teenager and as an adult, and always wore a swimsuit – he did so on the occasion of the 10th, 20th and 25th anniversaries of the Nevermind album.

Split attitude

Sometimes, however, he had a split attitude toward photography. In 2016, he told the Times that as he grew, he was a little upset by such a bad reputation. “I woke up in the morning and I was part of this big project. It’s quite difficult – one feels known for nothing, “he said.

“When I went to a baseball game, I thought, ‘Everyone in this game has probably seen my baby’s cock.’ “I felt like I was deprived of parts of my human rights,” he explained.

He looked more optimistic in other interviews. “It’s always been a positive thing and it opened the door for me,” he told the British daily The Guardian, for example, six years ago.
