The lawyers of Cédric Jubillar, husband and main suspect in the case of the disappearance of his wife Delphine on the night of December 15 to 16, file this Wednesday afternoon a new request for the release of their client. They blame the investigation in particular for delays in examining a quilt seized in the couple’s washing machine.

Delphine Jubillar, Aussaguel by her maiden name, a 33-year-old nurse, disappeared on the night of December 15 to 16, 2020 from the home of the couple – in the process of divorce – that she formed with her husband Cédric. Eight months, therefore, and since then no body, no weapon, no confession. And in the middle of it all, a duvet that prevents many of the actors in the case from sleeping.

It is little, too little in the eyes of the three lawyers of Cédric Jubillar to justify the continued pre-trial detention of their client, the main suspect and indicted for intentional homicide of a spouse, in prison since June 18. They therefore decided to file a new request for release on Wednesday afternoon.

An analysis undertaken “at the end of July”

“New”, because it is the second after that filed on July 6, and rejected on 8 by the investigative chamber of the Toulouse Court of Appeal, again called to rule. It is the “slowness of justice”, according to the wording used this Wednesday morning on our antenna by Emmanuelle Franck, one of Cédric Jubillar’s advice, which motivates this approach. Defense lawyers particularly criticize the investigation for having already delayed too long in examining a duvet, found by the gendarmes in the household washing machine.

“We have unfortunately noticed that certain elements which we thought were in the file or in the process of being processed, were only so at the end of July. I take as an example the analysis of the famous duvet, presented as one elements to charge and keystone of the accusation “, thus lamented Maître Emmanuelle Franck on our antenna this Wednesday morning, as a prelude to the hearing this afternoon.

“This element was not sent for analysis until eight months after its seizure, that is to say at the end of July,” she insisted.

“We have just learned that the expertises relating to the duvet had been ordered in July, while it is an item seized since December. This slowness cannot make it possible to make this detention last”, was already annoyed earlier, Maître Alexandre Martin, also Cédric Jubillar’s lawyer, still with BFMTV.

Dirty laundry

However, this duvet quickly appeared as a crucial element of the dossier, prominently among the charges weighing on Cédric Jubillar. From June 18, at the time of indicting Cédric Jubillar, the public prosecutor of Toulouse, Dominique Alzeari, so declared during his press conference that a machine was turning when the gendarmes presented themselves on December 16 at 4:50 am in the Jubillar house, in Cagnac-les-Mines, in the Tarn, as soon as the report of the disappearance of the young person was received wife. Next to him, Colonel Philippe Coué, commander of the Toulouse research section, then completed: “When the gendarmes arrive at the home at 4:50 am, Mr. Jubillar is putting (sic) a washing machine. In the drum, there is in fact the duvet which is on the sofa in the living room. Sofa on which his wife usually sleeps with whom he is in the process of separation. Which is – as the public prosecutor said – quite astonishing in the context ” .

“When the gendarmes intervene at 4:50 am, they intervene with the very fragmented information that they have obtained and do not have, at that time, any suspicion against Cédric Jubillar so it is in a second time that ‘we are going to intervene concerning this washing machine “, justifies the officer, who notes:

“The duvet has in the meantime been removed. And we will do analyzes in particular on the siphon of the washing machine.”

A laundry … but a program that questions

But the temporality of this dry cleaning of discord is more muddled than it seemed at first glance. During the hearing conducted in July, the Toulouse Court of Appeal indeed established, as pointed out at the time La Dépêche du Midi, that no laundry was in progress when the officers arrived and that the duvet had not been discovered, washed, in the drum until July 17. “We would not understand why he would be released in the current state of the case. Since the investigating chamber of the Court of Appeal ruled in July, no new element has appeared with the judges of instruction or the various parties. It would be hard to understand how the investigating chamber which considered that there were serious and consistent evidence against Cédric Jubillar could take a decision two months later without any new evidence “.

The investigating judges will have ten days to provide a written response to the request for release issued by Cédric Jubillar’s lawyers on behalf of their client from the time it has been formulated.
