The mediated conflict between Attorney General Maroš Žilinka (51) and Special Prosecutor Daniel Lipšic (48) is gaining momentum. Lipšic was supposed to commit a disciplinary offense by, as the General Prosecutor’s Office stated, on 28 July, without knowledge of the file, publicly speculative and misleadingly arguing against the investigators of a specialized team of the Inspection Service in a legally unfinished criminal case that did not fall within the Office’s jurisdiction. For disciplinary proceedings, Lipšic is to lose 15 percent of his monthly salary.

Today, the special prosecutor announced another unexpected report. Peter Kysel ended up as the authorized deputy special prosecutor, he said on the social network Lipšic. “He was and is one of our best and most experienced prosecutors. He adds that it was very important for him to be able to rely on an experienced prosecutor with good management skills in the management of the ÚŠP. He did not state the reason for the termination of Kysela as Lipšic.

In recent months, Peter Kysel has been known mainly for overseeing the case of former SIS Director Vladimír Pčolinský. He also faced several disciplinary motions filed against him by Attorney General Maroš Žilinka. “We can confirm that a motion to disciplinary proceedings was filed on May 13,” Dalibor Skladan, spokesman of the General Prosecutor’s Office (GP) of the Slovak Republic, told TASR in the past. The proposal concerns the case of the director of the Office of Special Police Activities, Jozef Rehák, when Kysel processed the defendant’s application for release from custody for a period of almost two months. Žilinka considers this to be an obvious resignation to the legal obligation to handle custody matters preferentially and expeditiously.

The second proposal was submitted in early August. It concerns delays in proceedings in the case of former SIS Director Vladimír Pčolinský. At that time, Žilinka also refused to appoint Kysela as Deputy Special Prosecutor, despite the fact that Kysel won the tender and was unanimously approved by the Board of Prosecutors. Žilinka did not explain his decision. At that time, Žilinka also filed a second disciplinary motion against Petr Kysel.

Peter Kysel took up the position of Deputy Special Prosecutor on February 23, 2021. Prior to that, he worked as a prosecutor in the Department of General Crime within the ÚŠP. Kysel is one of the three unsuccessful candidates for the position of special prosecutor. On February 5, members of parliament elected Lipšica to this position with 79 votes out of 117 present.
