Why is the driver from Čadka in custody and Dědeček is not? The decision of the regional court surprised even experts – noviny.sk

BRATISLAVA / While the drunk driver from Čadka has not yet killed anyone and ended up in custody, former sports official Dušan Dědeček is free. And this despite the fact that he killed five people and seriously injured others while drunk. The mentioned two cases raise several questions. You can read why one of them ended up behind bars and the other in this article. “Each judge decides on the basis of the particular case and the particular profile of the perpetrator. On the basis of what kind of person it is, what kind of further development is expected of that person,” stated the rector of the Police Academy in Bratislava, Lucia Kurilovská. The driver from Čadka has 12 entries in the criminal record. Dušan Dědeček is being prosecuted by the prosecutor because he is afraid that he will escape. He also argued against the impending life sentence. He was also afraid of continuing criminal activity. In the last 11 years, Dědeček has committed 16 offenses behind the wheel. He exceeded the maximum permitted speed and did not respect traffic signs. However, the pre-trial judge was not convinced by the prosecutor’s arguments. “Since the threat in identical or similar proceedings does not arise from the actions of the accused and other specific facts,” reasoned the spokesman of the Bratislava Regional Court in Bratislava, Pavol Adamčiak. Dušan Dědeček – escape from journalists The judge pointed out that he was deciding on custody and not on the guilt of the accused. “Therefore, even the fatality and inexcusability of the consequences of the defendant’s deed does not justify the custodial prosecution of the accused,” added Adamčiak. Both Kurilovská and the prosecutor were surprised. He is still in custody. At the same time, he points out that the former sports official is still being prosecuted and no one has acquitted him of the charges. “The court’s decision has no effect on the fact that the objective investigation will continue. The act happened, it was committed by the accused,” said Juraj Chylo. Dušan Dědeček regretted the deed in front of the judge yesterday. According to our information, he stated that he is an occasional user of alcohol. At the same time, he added that he is seriously ill and has several diagnoses. Since the prosecutor filed a complaint against the pre-trial judge’s decision, the Regional Court will decide the fate of the accused next Friday in a public session. “It can be decided that the person will be taken into custody and the prosecutor’s complaint will be accepted, or he will not be taken into custody, that is, the prosecutor’s complaint will be rejected, or thirdly, custody will be replaced by one of the institutes for the replacement of custody, for example by a written promise or a monetary guarantee,” concluded Tomáš Strémy from the Department of Criminal Law, Faculty of Law, Comenius University in Bratislava.
