BRATISLAVA. The Ministry of the Interior (MV) of the Slovak Republic submitted an amendment to the Act on the Police Force (PZ) to the inter-ministerial comment procedure.

It includes, for example, the introduction of the basic structure of PZ, but also the abolition of nameplates on uniforms or the possibility to open an apartment even if there is a suspicion that an animal is being abused.

An offense against public policy consisting in insulting a public official in the exercise of his powers could also be introduced.

The basic structure of the Police Force is to consist of the Presidium of the Police and departments with competence for the entire territory and with local competence.

“Such a freely set up more detailed organization is also related to the planned organizational changes in the Police Force,” the ministry pointed out in the explanatory memorandum. The position and basic tasks of the Criminalistics and Expertise Institute of the PZ are enshrined in particular.

The law is also intended to abolish the obligation to wear a badge on police uniforms.

“In many cases, the performance of official interventions involves finger-pointing, threats against intervening police officers and their family members, as well as the recording of personal data of police officers,” argues the Ministry of the Interior.

The police officer should also be entitled to request an explanation from the person who can contribute to clarifying the facts relevant to the detection of the crime.

They could detain not only a person at the scene of the crime immediately after it has been committed, but also a person caught in or immediately after the crime and also a person found on the run.

In order to ensure the safety of designated persons and objects, an authorization should be introduced to prohibit the operation of drones over the designated object up to a height of 120 meters.

The right to close public places is also proposed in the event of a threat of a mass violation of public order. Police officers could also open an apartment or other area if there is a reasonable suspicion that there is an abused animal.

The Ministry also proposes the possibility of breaking banking and telecommunications secrecy in the identification of a person suspected of committing a misdemeanor against property, for example in fraudulent sales via the Internet.

When searching for stolen mobile telecommunications equipment, operational and location data would also be possible at the written request of the owner, operator or holder of the telecommunications equipment.

Police officers could also have the right to request an examination to detect alcohol consumption through a guiding breath test or other addictive substance, if necessary.

“This is mainly due to the fact that the ability of a person with whom a police officer performs acts related to clarifying illegal activities, such as interrogation, confrontation, reconstruction, may be affected by the consumption of alcoholic beverages or other addictive substances,” the ministry explained.

The handcuffs could also be used to handcuff a person who, at the discretion of a doctor, is to be placed in a medical facility and actively resists, attacks other people, or endangers his or her life, health or property.

The law also responds to the regulations of the European Parliament and the Council of the European Union on the establishment, operation and use of the Schengen Information System (SIS) in the field of police cooperation and judicial cooperation in criminal matters.
