The District Court in Dolný Kubín convicted the priest František Ondrek in June. He received a three-year sentence suspended for four years for the ongoing crime of sexually abusing a minor girl. This caused a wave of outrage and disgust. After massive media coverage, Prosecutor General Maroš Žilinka shed light on the case. “In the criminal case of the convicted FO priest for the continuing crime of sexual abuse, in which the Dolný Kubín District Court on June 28, 2022 approved a plea agreement and imposed a suspended prison sentence on the convicted, I examined the procedure of the deputy district prosecutor in Dolný Kubín and came to to the conclusion that it was not in accordance with the law. The deputy district prosecutor’s procedure for supervising compliance with the law in the preliminary proceedings did not ensure proper ascertainment of the facts of the matter, she evaluated the obtained evidence incorrectly and, as a result, incorrectly and incompletely qualified the act,” Žilinka published on social networks. According to the general prosecutor, a milder legal assessment, i.e. underqualification of the act, then also caused an disproportionate punishment, which in this case was only a condition. “Not even the fact that, in the end, the judge of the Dolný Kubín District Court approved the plea agreement concluded between the accused and the deputy district prosecutor can change this fact. The identified chain of misconduct in the given case is of such a nature that it is impossible to tolerate and will have personnel consequences,” said Žilinka. He added that he ordered the regional prosecutor in Žilina to take certain measures to prevent similar violations of the law in the future. At the same time, Žilinka ordered the Director of the Criminal Department of the General Prosecutor’s Office of the Slovak Republic to carry out a review of the legality of the procedure of the prosecutors in the district of the Žilina Regional Prosecutor’s Office in the proceedings on the plea agreement.
