The new Secretary of State is a gynecologist, long engaged in the fight against endometriosis, and is accused of non-consensual penetration within the framework of a medical act. In one month, two complaints of rape targeted the new secretary of State for Development, Francophonie and International Partnerships Chrysoula Zacharopoulou, and an investigation has been opened. Appointed member of the government following the re-election of Emmanuel Macron at the end of May, she comes from the medical world, and practiced until then as a gynecologist. She is accused of non-consensual penetration as part of a medical act. Chrysoula Zacharopoulou – elected in 2019 on the Renaissance list in the European Parliament, where she notably sat on the Committee on Women’s Rights – is a long-standing doctor date on the issue of endometriosis. She had submitted a report on the subject to the French government last year. Who are the complainants? The first complaint was filed by an ex-patient of Chrysoula Zacharopoulou on May 25 for acts of rape. A second woman, an adult at the time, also filed a complaint on June 16 for similar facts. A third woman, now 26, told AFP on Wednesday that she consulted this gynecologist at the end of 2016 for health problems. endometriosis. She explains that she experienced her consultation “at least as a sexual assault”, but did not file a complaint at this stage. “I thought no one would believe me, but today it’s different,” she said, adding that she “hesitates” to do so. What is Chrysoula Zacharopoulou accused of? . The two women who filed a complaint testified to their experience in the Daily program, on TMC, broadcast this Wednesday. A first woman explains that she refused a rectal examination during a consultation in January 2016, an act that nevertheless was imposed by the gynecologist. “I tell her no. I see that I have no say and she puts on her glove. I started crying. Then she came back”, she says, explaining that she was “totally frozen, I couldn’t speak, I couldn’t breathe, I was cut off from everything. I was crying in silence. I said that I was in pain, she said to me: ‘no c ‘is good, it’s only a digital rectal examination'”. The second complainant had consulted the gynecologist for endometriosis problems, and describes facts dating back to June 2016. She recounts having undergone “a vaginal examination without a word , without saying anything to me, by surprise, which completely tenses me up and makes me burst into tears directly“. She also underwent a rectal examination “without consent either”, during which she burst into tears “because it’s brutal, it’s violent and it’s very painful. I’m in a state of complete amazement”. She explains to the show to be in a “post-traumatic state which is very difficult to deal with even today”. This plaintiff says on the other hand that the day of her consultation, “all the young girls before me left the meeting in tears”. Where is the investigation? The challenge for justice will be to understand if these non-consensual medical acts can be criminalized. The ongoing investigation will have to determine the nature of the facts, in particular whether there was rape or gynecological violence. The minister has not yet spoken about the complaints against her, and her lawyer has declared to of the Quotidien program that she was bound by medical secrecy and could not talk about her patients. Chrysoula Zacharopoulou worked for several years at the Paris Hospitals (AP-HP), in particular at the Tenon hospital, in renowned gynecologist Émile Daraï. The latter, former head of service at the Tenon hospital, is the target of around twenty complaints of rape from former patients. The Paris prosecutor’s office ended up opening a judicial investigation against him for violence by a person exercising a public service mission, and not for rape. at the end of September 2021 following the accusations concerning Professor Émile Daraï”, and “particular attention was paid to the reporting and processing of patient complaints”, assured the AP-HP to AFP. The director general of the AP-HP, for his part, assured in a tweet on Wednesday that he had “never had the slightest complaint or complaint raised to the AP-HP against this doctor” (Chrysoula Zacharopoulou, editor’s note), stressing that she had “fought so that the suffering of women with endometriosis is better treated and becomes a health priority”. · What does the law say? The existence of gynecological violence has been pointed out for several years. A hashtag #PayeTonUtérus had thus been launched in 2014, under which women had recounted “brutal vaginal examinations or acts carried out without their consent, up to sexual violence”, recalls the High Council for Equality between women and men. Since then, speaking out has multiplied and frameworks have been put in place. In 2021, the National College of French Gynecologists and Obstetricians (CNGOF) published a consultation charter for this specialty, in order to protect patients. She recalls, among other things, that a gynecological consultation “is not a consultation like any other since it affects the privacy of patients” and that “the woman’s oral agreement is obtained before any clinical examination.” On the other hand, it is specified in article L1111-4 of the Public Health Code “that no medical act or treatment may be performed without the free and informed consent of the person and this consent may be withdrawn at any time.”Salomé Vincendon Journalist BFMTV
