Rentals are very strict in France, especially in urban areas with more than 50,000 inhabitants. And an owner learned it the hard way recently, explains Le Figaro. The case dates back to September 2020. A tenant leaves his accommodation in the 6th arrondissement of Paris. It is a three-room apartment of around 68m². Its owner decides to re-let it immediately, but increases the rent: 2,875 euros (2,700 euros of rent, and 175 euros of provisions on charges). Problem is 645 euros more than the previous rent he was asking. That is. The new tenant accepts the rent. But as our colleagues explain, a year and a half later, at the end of December 2021, she takes the landlord to court to contest his rent. Even if she signed the lease, she has “three years to contest a rent deemed too high in the absence of an additional rent entered in the rental contract”, explains to Figaro the law firm Stas & Associés. It must be said that the law is clear: when a change of tenant is noted, the rent cannot be higher than the last applied, at least in areas like Paris. There are a few exceptions: if he had not been revalued in the twelve months preceding the new lease, but always within the limit of the Rent Reference Index (IRL) or if work has been done in the previous six months.
