Legislative 2022: the PS more fractured after the court decision calling into question its process of joining Nupes – Le Monde

A few hours before the ballot, the New Popular Economic and Social Union (Nupes) knows no legal respite. Tuesday, June 7, the Council of State gave him reason against the Ministry of the Interior, considering it “as a unique political nuance” for the two rounds of the legislative elections (June 12 and 19). On the other hand, the same day, the court of Créteil, seized in summary, called into question the process which led the Socialist Party (PS) to join the Nupes. These are four socialist activists, without responsibilities within the party, who took legal action. According to the judgment, the leadership of the PS should have organized a national convention, including the militants, and not be satisfied with a vote of the national council, the “parliament” of the PS, on May 6, to endorse – with 62% of the votes. – this agreement between the PS, La France insoumise (LFI), the Communist Party (PC) and Europe Ecologie-Les Verts (EELV). The judge ordered the PS to organize a national convention within a month, under penalty of a financial penalty of 500 euros per day. Read also: Article reserved for our subscribers The long decline of the Socialist Party The PS decided to appeal the decision and reacted under the pen of Corinne Narassiguin, number two of the party, who addressed the first federals: “In when the gathering of the left and ecology is experiencing a real political dynamic, some members of our party wanted to play into the hands of the presidential majority and thus reveal their true intentions by attacking the Nupes. (…) Such a national convention could not have been organized within the time allowed before the deadline for submitting applications, on 20 May. Moreover, this is not disputed by the applicants, thus demonstrating their sole desire to harm a political dynamic. “Fuzzy legal consequences Corinne Narassiguin also notes” that the judge in chambers did not cancel the agreement which binds the PS to Nupes. The legal existence of Nupes should not be called into question. “It is logical that the court did not censor the Nupes agreement itself, since it was not our request”, assures Me Frédéric Scanvic, lawyer for the applicants. “We also asked that the PS not be able to take advantage of the agreement, in particular, not to be able to exclude, possibly, dissidents from the party who presented themselves outside the Nupes agreement, continues Me Scanvic. That’s what the court decided. ” The management of the PS thinks exactly the opposite: ” The judge’s decision does not call into question the global agreement, believes Christophe Clergeau, close to the first secretary, Olivier Faure.
