(CNN) – An attorney for Britney Spears filed a petition asking the judge in her guardianship case to hold a hearing to immediately determine whether Jamie Spears will be removed as co-guardian of her daughter’s estate, according to court documents obtained by CNN on Thursday.

The next hearing is scheduled for September 29, but the singer’s attorney, Mathew Rosengart, has asked Judge Brenda Penny to hold the hearing this month.

“Every day that passes is another day of avoidable damages for Ms. Spears and the State,” the petition says. “The emotional health and well-being of Ms. Spears should be, and is, the primary concern.
