The District Court (OS) in Banská Bystrica on Thursday again convicted businessman Ján K. in the case of the old murder of Polish businessman Grzegorz Szymanek. He was sentenced to ten years in prison. OS had to deal with the case because the Regional Court (KS) overturned the verdict in 2021 and returned the case to re-examine and decide it to the necessary extent. The judgment is not final. The murder of the rich Pole Szymanek took place in the autumn of 1997 at a cottage outside the village of Polomka in the district of Brezno after the site where he was detained was revealed. According to the indictment, convicted Mikuláš Černák was to shoot him from the pistol into his mouth once and then Ján Kán from the same pistol into the chest area. It was allegedly an order of people from Poland and the goal was a ransom. He found both OS guilty in 2019. In the case of Černák, he abandoned the imposition of a collective sentence because he considered that the exceptional life imprisonment he was serving was sufficient. Ján Kán was then eight years old. They both appealed. KS in Banská Bystrica rejected the appeal of the accused Černák and upheld the decision of the district court. In the case of John Cana, he annulled the guilt and punishment verdict and returned the case. It concluded that the Court of First Instance had erred in its assessment of some of the evidence and that, in that regard, it was necessary to carry out further in accordance with the findings of the Court of Appeal.
