The law responds to current developments in Ukraine, which may result in mass migration of foreigners to Slovakia. It will be possible to declare an extraordinary situation even in the event of a mass influx of foreigners, the material also amends the laws on cyber security, civil protection and asylum. The law is also intended to establish a fund to help people adversely affected by the negative consequences of Russia’s military invasion of Ukraine. The law came into force by a statement in the Collection of Laws.

Disinformation sites may get a stop sign

The new legislation also introduces a new “blocking” institute to prevent the spread of harmful content on the Internet. This is brought about by the amendment to the Cyber ​​Security Act. The institute of “blocking” is to apply until the end of June 2022, it is to be decided by the National Security Office. The submitters point out the growing sophistication of the attacks.

“Malicious content means software or data that causes or may cause a cyber security incident. Malicious activity means any activity that causes or may cause a cyber security incident, fraud, theft of personal data or sensitive data, serious misinformation, and hybrid threats, “ it is stated in the law.

It will also be possible to declare an emergency situation in the event of an influx of foreigners

It will thus be possible to declare an extraordinary situation also in the event of a mass influx of foreigners, which will enable the implementation of economic mobilization measures, especially with regard to the need to provide accommodation for foreigners, transport arrangements or medical arrangements.

This follows from the law on certain measures in connection with the situation in Ukraine, which was approved by parliament on Friday. MEPs discussed the proposal in a shortened legislative procedure. The material contains amendments to the Civil Protection Act, the Asylum Act and Cyber ​​Security Act. Of the 121 deputies present, 82 supported the law, 11 were against, 27 abstained, and one did not vote. Members put an end to Friday’s special sitting by a vote.

The law responds to the current unfavorable developments in Ukraine, which may result in mass migration of foreigners to Slovakia. As the petitioner explains, after the declaration of an emergency, appropriate economic mobilization measures will be able to be implemented, in particular with regard to the need to provide accommodation for foreigners, the organization of transport security or the organization of health insurance, or the related imposition of work obligations.

Temporary refuge will be possible without a decision by the EU Council

The amended Asylum Act allows the government to declare temporary refuge even without a decision of the Council of the European Union. At the same time, the law specifies the provisions governing the provision of temporary refuge, such as the details of the initiation of proceedings, including decision-making deadlines, given the expected pressure on the capacity of the migration office.

According to the law, an alien requesting the provision of temporary refuge who has secured accommodation will not have to go to a detention camp. In order to speed up the procedure for providing temporary refuge, the danger of an alien to the security of the Slovak Republic will be examined subsequently. “In the case of facts justifying such a conclusion, the current legislation of the Asylum Act shall be followed and the temporary refuge shall be abolished for such a person.” it is mentioned in the joint report of the parliamentary committees.

In the proposal, the deputies also approved the possibility of financing the provision of accommodation to detainees who were provided with temporary refuge in the Slovak Republic in connection with the war in Ukraine. The contribution is to be provided from the state budget through the municipalities on whose territory the accommodation will be provided. “The contribution will be provided to the landlord, while the amount of contributions will be determined by the government by regulation, depending on the real needs and possibilities of the state budget,” noted in the joint report of the committees.

He emphasized the unity of the government and parliament on this issue. According to him, citizens should also be encouraged to welcome the people of Ukraine and help them find temporary refuge.

The law has already been signed by the president

President Zuzana Čaputová signed a law on certain extraordinary measures in connection with the situation in Ukraine, which was approved by the National Council of the Slovak Republic on Friday (February 25).
