Four years have passed, but justice still remains blind. For the murder of the journalist and his fiancée, the courts have so far only sentenced the executor Miroslav Marček and his driver Tomáš Szabó, both to 25 years in prison. Mediator Zoltán Andruskó was steamed for 15 years.
He released two identified murderers – the controversial businessman Marián Kočner and his heron Alena Zsuzsová. However, the Specialized Criminal Court (ICC), based on a decision of the Supreme Court (NS), will start dealing with their case again at the end of February.

The NS Senate ordered the execution of a large amount of evidence and its evaluation not in contradiction with elementary logic. According to him, ŠTS made several mistakes in its decision-making and did not properly find out the facts in the liberating part.
In addition, he did not deal with all the circumstances of the case, did not give a clear statement of reasons for the decision, and did not take all the evidence. And he assessed the others in isolation, and not in connection with other evidence, which is contrary to the Criminal Procedure Code and therefore led to an incorrect legal conclusion. “resulting in an acquittal”.
However, they connected the case for a joint hearing with the preparation of the murders of three prosecutors – Daniel Lipšic, Petr Šufliarský and Maroš Žilinka. In addition to Kočer and Zsuzsová, Tomáš Szabó, Dušan Kracina and Bosnian citizen Darko Dragic are facing charges in this matter.
From the conclusions of the investigation of these acts in the past, the survivors of Kuciak and Kušnírova expected the strengthening of the evidentiary situation in the original case of the liquidation of the journalist and his fiancée. “At the time, they refused to join the cases. But now I’m no longer convinced that it will be in our favor. I have learned information that I will not comment on. There is some evidence, but it will not help us. It looks like our the case will be lengthened unnecessarily and we will also have to go through hearings that do not concern us and justice has been delayed again. “ Zlatica Kušnírová began angrily.

On the anniversary of Kušnírová, Kuciak’s parents will come to unveil a memorial to those murdered on SNP Square in Bratislava: “We will be traveling over the weekend. We will also go to our children’s house in Velká Mača. We are carrying a wreath on the fence, we are going to light candles. We have such a habit that we always enter the house. Martinka and Janka’s bodies were lying in a pool of blood. We still have it in front of our eyes. In those places we will light electric candles, sit in the kitchen where my daughter was shot, pray the rosary and go away. ” she told us late last week.

The defense and the prosecutor suggest examining several pieces of evidence: Quotes from Kočner’s Threemy, further communication between Kočner and Zsuzsová, USB key found in Kočner’s house, which contains videos from Kuciak’s surveillance, hearing important witnesses, reconsideration of inconsistent statements by Zsuzsova and the day after the murder, communication between Zsuzs and her daughter the day after the murder, which is supposed to prove a quick change of plans or a deeper analysis of the range of BTS stations, records of telephone calls from the custody between Kočner and witness Peter Tóth, analyze the movement of Kočner and Zsuzs the day after the murder.
The proof should also include the key USB key found during the house search at the Kočner family and the communication between Kočner and Zsuzsová about the dream with a tooth dropped out on the day the couple was shot. Zsuzs wrote to Kočner: “My mother is telling me now that she thinks that if she dreams of teeth falling out, someone will die.”
According to Kušnírova, this is a reference to death, and the defendants talk about the murder of Martina and Ján in this communication. A team of experts from Comenius University in Bratislava has a similar opinion. “We have come to the conclusion that these people have sought to confuse their ambiguity through the surrogate use of the terms, obscure the meaning of the communication and deliberately encrypt it so that it remains misunderstood by a third party at the outset.” they wrote in an expert report on the analysis of communication between Kočner and Zsuzsová via the encrypted mobile application Threema.
