VACCINE PASS. This Sunday, the law on the vaccine pass should be voted definitively in the last reading in the National Assembly. This Saturday, the text was adopted by the deputies and by the senators in second reading.
The essential
- This Sunday, January 16, the text of the law on the vaccine pass should be adopted in final reading by the National Assembly. After two weeks of adventures in Parliament, the law will be studied from 4 p.m. According to the president of the law commission of the National Assembly, Yael Braun-Pivet, “the vaccine pass could be applicable at the end of next week”.
- This Saturday, January 15, the Senate in turn adopted the bill for the vaccine pass with 187 votes for and 66 against, at second reading, after the National Assembly voted on it overnight from Friday to Saturday.
- What is the difference between the vaccination pass and the sanitary pass ? French people over the age of 12 must present a complete vaccination schedule or a recovery certificate to the Covid-19. Negative PCR or antigen tests will no longer be accepted.
- Unlike the health pass, the vaccination pass will not apply in health establishments and services, nor in journeys between the continent and Corsica by boat or plane, nor for school outings and extracurricular and extracurricular, cultural or sports activities up to at the age of 16 years. The Senate also wants to exclude it from shopping malls.

11:35 a.m. – “The vaccine pass will come into effect as soon as possible”, according to Brigitte Bourguignon
Guest of FranceInfo this Sunday, January 16, the Minister Delegate for Autonomy and Departmental Councilor of Pas-de-Calais, Brigitte Bourguignon, was optimistic: “The vaccine pass will come into force as soon as possible.”
10:52 – Sandrine Rousseau standing up against the vaccine pass
At the microphone of FranceInfo this Sunday morning, Sandrine Rousseau strongly criticized the vaccine pass: “What it does, this vaccine pass, is that it designates enemies from within, adversaries from within, it designates non-vaccinated people as being responsible for this epidemic, but that is not true.”
The government wanted the vaccine pass to come into effect from January 15, 2022, but the parliamentary agenda has been turned upside down. Last week, MEPs suspended debate twice in the Assembly following Emmanuel Macron’s controversial remarks on the non-vaccinated, then the bill “to transform the health pass into a vaccination pass” was again slowed down on January 13 by the failure of the joint joint committee. After the new examination of the law by the two chambers (Friday for the deputies, then Saturday or Monday for the Senate) the law should not be adopted before Monday, January 17. Government spokesman Gabriel Attal had already anticipated this new schedule when he spoke on Sunday January 9, explaining that the law on the vaccine pass could be adopted “in the week of January 17”.
With this measure, the government clearly aims to “bring pressure to bear on the non-vaccinated” in the words of the Prime Minister on Friday, December 17 at a press conference, who judges that it is “no longer possible” to have nearly 5.3 million unvaccinated in the country. During his speech, John Castex recalled the importance of vaccination and recall, particularly in the “speed race” against Covid-19 and the Omicron variant which has become the majority in the territory. In addition, he specified that this law should make it possible to “toughen up controls and sanctions against false passes”.
If the law is adopted, the places subject to this new pass will be almost the same as those currently subject to the health pass, since it is a transformation of the latter, with the exception of health establishments, transport to Corsica or Overseas, where the health pass will remain in force. You will necessarily have to have been vaccinated (or cured of Covid under certain conditions) to go to the following places:
- Restaurants, bars and cafes, including terraces.
- trains long distance (TGV, Intercités, night trains): the trains concerned by the health pass will be “subject to this vaccination obligation”, according to a ministerial source. This should be clarified soon. The pass is not required for everyday transport (the TER, RER, Transilien, metros and buses are not concerned).
- Campsites, hotels and holiday centers in certain cases only : Campsites, holiday centers and hotels which only offer accommodation are not subject to the pass. On the other hand, campsites, holiday centers and hotels which have a restaurant, a bar, a swimming pool or a performance hall, require the pass, but only once on arrival at the campsite, and regardless of the duration of the stay. .
- Gyms or swimming pools : the pass is valid for access to all sports establishments, i.e. weight and fitness rooms, indoor or outdoor swimming pools.
- Stadiums and other outdoor sports establishments : the pass is required to enter a stadium.
- Ski stations : the pass is made compulsory on board the ski lifts.
- Museums and monuments : At theTriumphal arch, the Eiffel Tower, the Castle of Versailles or any other museums and monuments, the pass is required.
- Amusement parks : the pass is required to go to the amusement parks, such as the Asterix Park, the Futuroscope or Disneyland Paris.
- Concerts and festivals : the obligation concerns concerts, shows and festivals bringing together more than 50 spectators.
- Movie theater : the pass is valid in cinemas.
- Theaters and other performance halls : theatres, operas, conservatory, lyrical art… The pass is compulsory when the capacity exceeds 50 spectators.
- Exhibition and fairs : a contemporary art fair, such as the FIAC, a major fair such as the Salon de l’Agriculture, du Chocolat or even the Salon du Livre or the Mondial du tatto… The accessibility of all these places is subject to the pass. It is required at fairs and shows with a capacity of more than 50 people.
- Casinos and other gaming halls : casino activities, with or without contact, as well as bowling alleys, escape games and gaming rooms.
- Places of worship : establishments of worship “under type V”, i.e. churches, mosques, synagogues or temples, are subject to the pass only within the framework of activities “which are not of a religious nature”, i.e. leisure activities such as a concert or show, organized in these establishments. But in no case is the pass required during ceremonies or times of prayer.
- Weddings : if the wedding ceremony takes place in a private place, the pass is not required. On the other hand, in places accessible to the public (village hall, etc.), it is.
- boat cruises : the pass is mandatory as long as 50 passengers are present.
- discos : nightclubs are subject to the pass.
- Shopping centers and department stores : the vaccination pass may be required by decision of the prefect.
- Trip : the pass is mandatory for inter-regional connections in mainland France. Connections with Corsica or the Overseas Territories are exempt from the vaccination pass because they are part of the border health pass.
While the possibility of requiring employees to present a vaccination pass to their company in order to be able to work has been considered, discussions with employee and employer representatives have led the government to review its position on the subject. The hypothesis will therefore not appear in the bill.
More than ten countries already use the vaccine pass in the world. Recently, Sweden opted for the vaccination pass from December 1 for indoor gatherings of more than 100 people. A new measure which comes as the country has one of the lowest incidence rates (197 cases per 100,000 inhabitants) in Europe. Since November 18, the Czech Republic has also been using this system. To enter shops and restaurants, hotels, museums or sporting events, you must be vaccinated or cured of Covid-19. Even stricter is Latvia, which has announced that unvaccinated MPs have been suspended from office since November 15. A decision that should last at least until July 2022 and then will be reviewed every two months. Finally, Estonia which combines technology and the vaccine passport. Indeed, the country had launched a digital “immune passport” in June 2021 for all employees in the country. Thus, once the employees have arrived at their workplace, they must present their mobile phone to a terminal which analyzes their immune system against Covid-19.
