BRATISLAVA. The Supreme Court has not found a reason to dismiss the charge against the former special prosecutor Dušan Kováčik and businessman Petr Košč in a case where they are accused of corruption.
The Senate granted the prosecutor’s complaint, annulled the resolution of the Specialized Criminal Court and ordered him to act and decide on the matter. Supreme Court spokeswoman Alexandra Važanová informed TASR on Tuesday.
“ŠTS is bound by the opinion of the Supreme Court, and therefore it must act on the accusation,” she added.
A judge of the Specialized Criminal Court in Banská Bystrica dismissed the indictment on November 2 for serious procedural errors and returned the case to the prosecutor. Dušan Kováčik’s lawyer Erik Magál clarified that the court rejected the accusation, among other things, because Prosecutor General’s Office The Slovak Republic did not decide on the petition pursuant to Section 363 of the Criminal Procedure Code.
