IMAGE RIGHTS – In a video posted this Tuesday noon on Youtube, Eric Zemmour announced his candidacy for the presidential election using numerous images from the news or films. Problem: several extracts were broadcast without the consent of the authors.

A campaign barely launched, and already a first pitfall. To announce his candidacy for the presidential election, Eric Zemmour decided to stuff his video broadcast this Tuesday on his YouTube channel with images mixing scenes of violence in France, from the archives of the “land of Notre-Dame-de-Paris and bell towers”, but also many film clips. How badly did it take him? It could well be.

Eric Zemmour, from polemicist to presidential candidate
Several media denounce the use of extracts without any authorization. Thus, the international news television channel France 24, indicated “oppose in principle the use of its images and logo in any political campaign clip”. “As a result, the channel will request the immediate removal of these images in this clip and will study legal remedies if their request is not followed up.”, she added.
Possible legal actions
For their part, France Télévisions, Ina and Radio France jointly declared: “Eric Zemmour should pay the rights to the images taken like everyone else”. The three state-owned media said no one had asked for permission for their images. On the other hand, BFMTV which, like the others, had not been solicited for the use of its images, declared that“she would not take legal action.”
A spokesperson for the Public Senate channel noticed that there was “five seconds of images with the logo of Public Senate, which were not their property since they belonged to En Marche”. “We are going to order candidate Zemmour’s team to remove our logo”, he told AFP.
While the Huffington Post announced in the early evening to sue Eric Zemmour for the use of two clips of video belonging to the news site. “It was therefore decided to initiate proceedings as soon as possible against the now candidate, in order to stop the distribution of these images illicitly reproducing the HuffPost logo, and to seek compensation for this abusive use of his notoriety” , wrote in a press release Louis Dreyfus, chairman of the management board of the Le Monde group, and Arnaud Aubron, general manager of HuffPost.
The Parisian, a daily which also makes videos, was also angry about the use of his images which “are not intended to serve any candidate”.
“An appropriation as revolting as it is scandalous”
Also firm position of the cinema distributor Studiocanal which holds the rights to four films used in the clip (“Quai des Brumes”, “L’Éclipse”, “A bout de souffle”, “Les Choses de la vie”) and confirmed not having received an authorization request. The same goes for Gaumont (Joan of Arc, A Monkey in Winter) who says he did not receive “no request” on behalf of Éric Zemmour’s teams for the use of images from the films “A Monkey in Winter” and “Joan of Arc” for which the company holds the rights and which reserves the right to initiate legal proceedings. The same goes for the Pathé Gaumont cinemas.
Archive images of personalities are also present in the video, such as Georges Brassens, Jean-Paul Belmondo and Brigitte Bardot, who rub shoulders with singer Barbara. His nephew, Bernard Serf, denounces in Telerama a “an appropriation as revolting as it is scandalous” of the image of the artist who died in 1997. “I have just discovered with amazement that Barbara is used as a guarantee in the clip of a candidate for the Presidency of the Republic whose name I refuse to mention. Is it necessary to specify that this appropriation as revolting as scandalous, when we knows the artist’s work and humanist commitments, was done without the consent of the family of the person concerned? “, he explains to the weekly.
Director Luc Besson and writer Jacques Attali reacted extremely vehemently to AFP against this use without their consent. The first announced to have seized his lawyer “to initiate the necessary proceedings” after Zemmour’s use of images from his film “Joan of Arc”, with Milla Jovovich, released in 1999. These images have been used in a manner “fraudulent”, specified the director who “would like to let it be known that he does not share Eric Zemmour’s ideas in any way”. Jacques Attali sent a formal notice to the presidential candidate to remove his image from his video edit within 24 hours.

Finally, the use of images of the Château d’Ussé, in Indre-et-Loire, would also be a “piracy”, reacted to France Blue Touraine its owner Casimir de Blacas. He said to himself “stunned” and assures that he has “never been contacted” by the polemicist’s campaign team. “That one uses the images of a private place for political ends seems unthinkable to me, it seems to me that it falls under a complaint. It is outright piracy. I have no particular attachment with Eric Zemmour, no more than I have any connection with any other candidate “, he stressed.
The quarrels of jurists must be interested in jurists.
Eric Zemmour’s team defends itself against criticism by citing the said law “short quote”, in an email to AFP. More nuanced, Olivier Ubéda, the national director of the events of Eric Zemmour, indicated this Tuesday evening on LCI that“there are seven images on 95% of the clip on which the lawyers do not agree on the right to the image, especially when the duration of the image is less than 3 seconds, which is the case for some between them”. “There is a subject on this and we are dealing with it, but it is not fundamentally essential”, he argued against Ruth Elkrief.
As for Eric Zemmour, he kicked in touch stressing in the 20H of TF1 that “the quarrels of jurists must be interested in jurists”. “I don’t take care of that”, replied the candidate.
