Eavesdropping from the hunting lodge was made possible by a bad legal qualification – SME.sk

BRATISLAVVA. The creation of mediated wiretaps from the hunting lodge should have been made possible by an incorrect legal qualification. This follows from the resolution on the cessation of criminal prosecution for its illegality, which was provided by TASR to the Nitra Regional Prosecutor’s Office.

Bad classification

Poaching was tested as a crime committed by a more serious conduct, specifically with a weapon. However, the regional prosecutor Ivan Mandalov considers this to be unreasonable, as in the case of attacks with a weapon, it is about people, not animals. He also pointed out that the investigator’s finding of a suspicion of money laundering did not stand up.

He emphasized that only that legal qualification made it possible to issue an order to make video, audio and video-audio recordings from the cottage.

The resolution on the initiation of criminal proceedings also criticizes the lack of legal requirements, especially as regards the description of the act. He also pointed out that the police investigator had not heard from the hunter himself in almost ten months.

Videos and their transcripts were published in several media in October, which show how the head of Smer-SD met at the hunting lodge Robert Fico, defender of the accused police ex-president Tibor G. Marek Par, former interior minister Robert Kaliňák, businessman Miroslav Bödör and son of Tibor Gašpar.

The official reason for wiretapping was precisely the case of poaching. Later, the recordings were to become part of the investigation of the Purgatory case. Regional Prosecutor in Nitre abolished the poaching prosecution on 16 November.
