Remišová submitted to the coalition council a proposal to change section 363 – SME.sk

BRATISLAVA. Minister for Investment and Regional Development and Chairwoman of the For the People party Veronika Remišová submitted a proposal to amend the 363 Criminal Procedure Code to the Coalition Council on Monday.

She emphasized that the current version of the section allowed the Attorney General to enter into criminal proceedings by practically circumventing court decisions on detention as well as on prosecution.

The proposal was agreed by the working group

According to Remišová, the provision became a weapon in the hands of the Attorney General Maroš Žilinka. She stated this in her social media profile.

The draft amendment to the section was submitted to the coalition as agreed by the working group for restoring confidence in the rule of law.

Any positive changes and reforms can only be made in a country where everyone is equal before the law and where law and justice really work, “concluded Remišová.

Kolíková considers Baránik’s proposal to be legitimate

The proposal of the Member of the National Council of the Slovak Republic Alojz Baránik (SaS) to amend section 363 of the Criminal Procedure Code is considered by the Minister of Justice Mária Kolíková considered legitimate. As she said for TASR, she also agrees with the wording of the proposal.

She is convinced of the need to narrow down the provision at issue.

“I think that Slovakia is at a time when it is very important to restore confidence in the rule of law. We have big corruption cases here, which are going to the highest peaks of political life, to former state officials, and it is really important to leave room to investigate as much as possible and “I think that if the prosecutor thinks that an indictment should be filed, he should be given the full space to file it,” Kolíková explained.

She recalled that the prosecutor may also have information that is of an operational nature, which he cannot put in writing in full.

“From this point of view, the proposal as presented by Baránik is one of the solutions, I also agreed with it and I consider it absolutely legitimate that it opens this debate,” Kolíková added for TASR.
