Former Prime Minister Robert Fico, former Minister of the Interior Robert Kaliňák, founder of the most famous security service Bonul Nitra oligarch Miroslav Bödör, renowned criminal lawyer Marek Para and son of police ex-president lawyer Pavol Gašpar made plans to discredit NAKA investigators and prosecutors of the special prosecutor’s office. One would not believe it if the day before the court about the extension of the detention of the police ex-president Tibor Gašpar, their audio-visual recordings did not appear in public. The security analyst is shocked. “This is for deep thought. The recordings from the cottage have a fairly low sound quality. Discredit?

According to Jana Tökölyová, a spokeswoman for the Office of the Special Prosecutor’s Office (ÚŠP), the recordings and their transcripts are meant to indicate more serious matters, which can be seen on the recordings so far. The recordings were officially made by the police for a completely different case. They said they wanted to expose some kind of poachers. The judge agreed to the deployment of information and technical means (ITP) in the cottage, believing that this was a case involving illegal hunting of wild game. The vice-president of the Slovak Bar Association, Ondrej Laciak, also thinks that this is not right. “By default, if wiretaps are legal but done in another matter, they may serve to prosecute as if for another act, but they are not applicable.” said Laciak. Admissibility must be decided by the court in each case according to the circumstances, and it is difficult to comment on this particular case for the time being, as micro-details decide what is legal and illegal.

Water preaches, wine drinks?

The question is why the videos that belong to the file actually appeared in public. Infringing someone’s privacy by eavesdropping is a gross violation of their rights. Not to mention that before the judge, the whole of Slovakia probably read them and played them.

The leak of the recordings is already being solved by the police, the criminal report was filed by the Purgatory investigator. Interim Police President Štefan Hamran informed about it.

“This testifies to the state of this republic and the whole system. If we want to criticize someone for the past, we should behave and act differently in the present and in the future. This only confirms that we still have a mess in Slovakia. I don’t know why someone finally won’t stop and say enough. I do not agree with this escape, “ says analyst Zábojník.

It is certain that special prosecutor Daniel Lipšic seemed to preach water and drank wine or did not have things under control. On the one hand, he says that “constant leaks about the content of specific evidence and the scope of planned acts make work difficult for law enforcement agencies and significantly disrupt the smooth running of the investigation”, on the other hand, his office easily evaluates and comments on leaked recordings from the file.

Such “leaks” are strongly condemned by the Slovak Bar Association. It is planned to deal thoroughly with the published recordings and their content, both from the point of view of ensuring the constitutional right to defense and observance of lawyer’s obligations, as they result from our regulations in order to protect the rights of clients of lawyers concerned.. “When someone said that, I think it’s a crime,” says lawyer Laciak.
