Martina Rossi case, semi-liberty regime for Albertoni and Vanneschi

The Supervisory Court of Florence ordered the detention under semi-liberty regime for Alessandro Albertoni and Luca Vanneschi, the two thirty-year-olds from Castiglion Fibocchi (Arezzo), definitively sentenced by the Supreme Court to three years of imprisonment for attempted sexual violence against the Genoese student Martina Rossi. The girl died at the age of 20 on August 3, 2011, falling from the terrace of the sixth floor of the hotel ‘Santa Ana’ in Palma de Mallorca while she was trying to escape from an attempted rape of the two young men from Arezzo who were staying in the same hotel. . The girl was in the well-known Spanish tourist resort on vacation with some friends. In the hearing before the Surveillance Court, held on 29 September, the Attorney General had asked for the alternative measures to be rejected, while the defenses of both convicts had asked for probation to the social services. The court decided to detain on a semi-liberty basis and yesterday, Friday 7 October, the public prosecutor received the decision and issued the execution order. Also yesterday, in the afternoon Albertoni and Vanneschi were constituted in the prison of Arezzo. The execution of the partial imprisonment order took place exactly one year after the final sentence of the Supreme Court, issued on 7 October 2021. In November 2021 the two young people had asked for probation to the social services which presupposes the resipiscence of the convicts and the compensation. It was Martina’s parents, Bruno Rossi and Franca Murialdo, who urged the Supervisory Court and the Florence Public Prosecutor’s Office to make a decision that was slow in coming.Albertoni, an excellent sportsman in the discipline of motocross, and Vanneschi, a craftsman, have always decisively denied the accusation. In the trial, the defenses argued the lack, according to them, of elements to attribute criminal responsibility to the two young people. Suicide or accidental event were the alternative hypotheses not accepted by the courts. The civil aspect remains open now with the definition of compensation for Martina Rossi’s family members. The girl’s parents – assisted by lawyers Luca Fanfani and Stefano Savi – after Albertoni and Vanneschi entered prison, commented with Adnkronos: “No one will return our daughter to us, but now justice is done. finally, a fixed point in a long and painful story, in which our daughter is the victim. And we died with her. “It was Martina’s parents who obtained the reopening of the case in Italy after the Spanish authorities had closed the practice excluding third party liability. The file passed from the Public Prosecutor of Genoa to that of Arezzo, with a first sentence of 6 years (also for the crime of death as a result of another crime) then the acquittal on appeal, the ruling of the Supreme Court which called into question the conclusions of second instance judges; then the bis appeal with the three-year sentences and the final seal of the Supreme Court.
