Murder Regeni, Rome prosecutor appeals in Cassation against trial suspension

The Rome Public Prosecutor’s Office filed an appeal with the Supreme Court challenging the order of the GUP of last 11 April suspending the trial on the murder of Giulio Regeni, the Italian researcher kidnapped, tortured and killed in Egypt in 2016. With this initiative, the prosecutor, with the assistant prosecutor Sergio Colaiocco, owner of the file, requests the annulment of the decision of the judge and even before that of the Court of Assizes of Rome in order to overcome the situation of procedural standstill that has arisen. The judges of the Third Court of Assizes of Rome on 14 October last, called to decide on the absence in court of the four Egyptian 007 accused, had in fact declared the nullity of the decree that ordered the judgment. The Prosecutor believes that it has to give a different technical assessment than that of the Assize Court to which the judge was bound, as regards the existence, or not, of the guarantees of due process recognized to the Egyptian defendants. The question is whether the fact that “there is reasonable certainty that the four Egyptian defendants are aware of the existence of criminal proceedings against them concerning serious crimes committed to the detriment of Giulio Regeni is sufficient for the trial to be held. “. In the opinion of the prosecutor, the decision taken would be contrary to what the United Sections of the Court of Cassation affirmed that it can proceed, even if the party ignores the date of the hearing and the charge, when it is in presence of unaware ‘fake’. Now it will be the supreme judges who will have to express themselves on the case.
