Vaccine over 50, mandatory even on the third dose: that’s who controls

In force since yesterday, the vaccination obligation for citizens over 50 also concerns the booster and dose booster. But how are Covid-19 vaccination checks carried out? The data held by health companies and those concerning the resident population will be cross-referenced. In this way, it will not be difficult to understand who, having reached the age of 50, is vaccinated and who is not, given that the inoculation results in the archives of the ASL or regional offices and that there is a list of people to whom it has been sent the link to download the Green pass. Who is not present in these lists has certainly not had the vaccine.After the authorities have ascertained the list of citizens whose names are not in the lists of vaccinated subjects, they will open an investigation. At this point, Agenzia Entrate-Riscossione will send the interested parties a notice of initiation of the sanctioning measure. At this stage, therefore, the fine is not yet imposed. The interested party will have 10 days – peremptory deadline – to respond to the communication, sending to the Local Health Authorities and to the Revenue Agency-Riscossione a certification certifying the non-existence of the vaccination obligation or the reasons that justify the deferral. Citizens must notify Ader of the successful transmission of the certification. The Local Health Authorities, in turn, will have 10 days – even these qualified as peremptory – to verify the certifications produced, also following a possible cross-examination with the interested party, and if necessary communicate to the Adder the validity of the same. Failure to respond by the ASL within the very short term of 10 days – compliance with which seems rather unlikely – constitutes “silent rejection” and therefore the sanctioning procedure continues. Agenzia Entrate Riscossione, once it receives the communication from the ASL referring to the “justified” subjects and therefore exempt from sanction, within 180 days from this, it will notify the defaulters a debit notice, pursuant to article 30, Legislative Decree 78/2010 which will have enforceable effect and will justify the initiation of the tax collection with attachment of assets.
