Payments with ATMs and cards, fines on arrival for those who do not use Pos

Payments with ATMs and cards, from 1 January it will no longer be enough to comply with the obligation to have the Pos: those who do not use it will pay a fine proportionate to the value of the denied transaction. Until now, laleggepertutti.it recalls, there was an obligation to have it but not a fine for those who did not want to use it. Now we change: sanctions are on the way for those who refuse payments with Pos. This was decided by the government, which in this way wants to take another step forward in the fight against tax evasion. The executive’s reasoning is very simple: it is useless to impose a tool for traceable payments on merchants or service providers if the consumer, as soon as he hints at pulling out a credit card or debit card, is told that electronic money is not accepted. and the shopkeeper, bartender or professional get away with it. Thus, from 1 January 2022, anyone who does not have a POS or has it as an unused piece of furniture will be punished with an administrative fine of 30 euros plus 4% of the value of the refused transaction. To give some examples: those who do not accept to cash in a 1 euro coffee with an ATM, will pay a fine of 30.04 euros for each denied transaction, while those who refuse the electronic payment for a 25 euro meal will receive a fine of 31 euros. euro, and so on. The higher the value of the good or service purchased, the more the amount of the fine increases. In doing so, the government tries to make sense of the obligation of the Pos. is sanctioned if he does not use it. Which, obviously, legitimizes those who want to collect in cash not to use the device for electronic payments, with the risk that some undeclared collection will escape us. The sanction, therefore, is introduced with this logic: any obligation imposed without a sanction for those who do not respect it is a useless obligation. And we might as well make useless things useful. Mario Draghi succeeded this time, after in the past the government of Giuseppe Conte tried unsuccessfully to impose sanctions against those who refuse the Pos. The obligation to accept electronic payments will be fulfilled even when only one type of card is accepted. debit card and at least one credit card, identified by the brand of the circuit to which they belong. Basically, the consumer must have the possibility to pay either by credit card or by debit card or other debit card. The crackdown on the Pos is added to the penalties for non-invoicing and for the failure to issue the receipt.
