NAKA investigators, who were detained by the Interior Ministry Inspectorate on Monday, will learn the verdict today whether they will end up in custody. The judge for the preparatory proceedings of the District Court (OS) Bratislava III will decide on Wednesday afternoon on the proposal of the prosecutor of the Regional Prosecutor’s Office (KP) in Bratislava for the detention of the accused. TASR was informed about this by the spokesman of the Regional Court (KS) in Bratislava Pavol Adamčiak.

“On September 15, 2021, the prosecutor of KP Bratislava filed a motion at the Bratislava III Armed Forces for the prosecution of five accused persons in order not to influence witnesses and to continue to commit criminal activity,” TASR was informed by Dalibor Skladan, spokesman for the General Prosecutor’s Office (GP). .

The motion for detention was filed against the temporarily appointed head of the Office of the Inspection Service, Petr Scholz, and members of the National Criminal Agency (NAKA), Ján Čuril and Pavel Ďurka, as well as their colleagues Štefan Mašin and Milan Sabota.

Prosecutor Juraj Chylo wrote in a motion for detention that the accused police officer Sabota confessed and thus convicted the other accused investigators. He allegedly “confessed, stating that he had carried it out as stated in the grounds of the resolution.”

Sabota, along with other investigators, is accused of preparing an investigation of people from the inspection and their co-workers at the National Criminal Agency, who in turn participated in another investigation into allegedly manipulated witness statements.

However, his lawyer Rastislav Koutun denies that his client confesses and claims that this is a misinterpretation. His client allegedly only confirmed that the police were planning an investigation against the suspects from the inspection, but in a lawful manner.

Why the prosecutor is seeking the detention of NAKA investigators

The prosecutor’s office justifies the proposal for the collusive detention of accused police officers also by the fact that they have been working in the same workplace for a long time within the same working group at NAKA. According to him, it is therefore probable that, as they have so far coordinated and negotiated joint action in specific criminal cases, if they were left free, they would thus coordinate or negotiate testimonies in ongoing criminal proceedings. “

The prosecutor is convinced that after the accusation, it will be necessary to re-examine witnesses who have already been heard in the past. The prosecutor says there are concerns that if police officers were charged at large, they could try to contact these witnesses to adjust or direct their statements.

He also points to the event that happened during the detention of NAKA member Štefan Mašín. At that moment, this investigator was to tell a colleague who was in his office with him to call Daniel Lipsic. According to the prosecutor’s office, this is an obvious attempt to influence criminal proceedings through a special prosecutor.

In the case of the motion for pre-trial detention, he argues with the findings of the investigation so far that, if left free, they would continue to blame them in the accusation – that is, in an attempt to criminalize the persons concerned.

The prosecutor also pointed to a well-known implementation proposal. It shows that the alleged NAKA members wanted to continue to investigate members of the inspection team who were dealing with the alleged manipulation of witnesses.

The Prosecutor recalls that the implementation proposal was signed despite the fact that the original criminal prosecution in the case was canceled by the Prosecutor General’s Office.

The authorized head of the Inspectorate is charged with a continuing crime

Scholtz was charged with the continuing crime of abuse of power by a public official and the crime of obstructing justice.

“After issuing a resolution on 10 September 2021 to initiate criminal proceedings, the prosecutor of KP Bratislava raised charges of PS on 14 September 2021 for the continuing crime of abuse of power by a public official and the crime of obstruction of justice,” Skladan mediated the opinion of KP Bratislava. Peter Scholtz was detained on Monday.

According to Aktuality.sk information, Scholtz was accused of purposefully bringing information from the Oblúk inspection team to investigators in the Očistec team. He then recalled the head of the Oblúk team, Diana Santusová, who was investigating the allegedly manipulated statements of witnesses to the big cases.

At the same time, Scholtz is also being prosecuted for giving consent, as the authorized head of the Office of the Inspection Service (ÚIS), to the investigation of suspicious people from the inspection by investigators from NAKA and not from the Inspection Service.

In the case where Čurilla and Ďurek are accused, the Inspectorate investigates two acts. In the first of these, the mentioned investigators had to miss the opportunity for the sought-after high-ranking member of the Takáčov gang, Martin Mikulec, to return from Croatia and testify, although at the beginning Čurilla was to ask him about it by phone.

Investigator Pavol Ďurka is accused of writing and editing the testimonies of a well-known witness – Csaba Dömötör, a fighter, who is already convicted of a false statement. According to the Investigator from the Inspectorate, Ďurka wrote the examination of the witness partly according to himself and not as he testified. The reason for his action was to try to have the testimony of witness Dömötör confirm the testimony of witness Matej Zeman about his alleged meeting with Ľudovít Makó and František Böhm in the Towers restaurant in Bratislava.

In this case, the inspection relies on already known evidence, which it collected on three other primary accused in the case of alleged manipulation of the svedective, ie Petr Petrov, Matej Zeman and Dömöter. However, new information was also added – investigators Ján Čurilla and Pavel Ďurka were recorded by a colleague at the time, who has been cooperating with the inspection for months and testifies about ex-colleagues. Ján Káľavský testifies about the alleged manipulation of witnesses and the adjustment of testimonies, but he is not accused himself.

Čurilla and Ďurka also face another accusation together with their colleagues Štefan Mašín and Milan Sabot.

In a criminal case for the crime of abuse of power by a public official, the ÚIS investigator accused four members of the NAKA. “On September 14, 2021, he brought charges against four members of the National Criminal Agency of the Presidium of the Police Force, Bratislava Department, J. Č., P. Ď., MS and Š. M., who will be heard in the presence of their lawyers, “the spokesman added.
