Griñán files annulment incident against his sentence to 6 years in prison

The former president of the Junta de Andalucía José Antonio Griñán presented this Tuesday in the Criminal Chamber of the Supreme Court an incident of annulment against the sentence of this Court that confirmed his sentence to six years in prison for embezzlement of public funds in the case of the ERE. It is a procedure prior to the appeal before the Constitutional Court that Griñán’s defense plans to file within the legally established period, according to legal sources. The high court confirmed the sentence imposed on Griñán in a sentence in which he states that he not only knew about and allowed aid to be paid knowing the “lack of control” and the “very serious illegalities” but that he did nothing to prevent it. Two dissenting magistrates and a request for pardon However, the individual vote of two judges opened the door for the former president of the Board to be able to fight his prison sentence in the Constitutional Court, and that is what he has begun to do. Both magistrates argued that there was a lack of evidence to show that Griñán knew that the money from the EREs was being misappropriated. Both magistrates criticized the “stubbornness” of some judges in convicting him and affirmed that the sentence was “a risky leap into the void.” Meanwhile, his family presented the petition for pardon for the former Andalusian politician on September 1. The petition bears the signatures of socialist leaders such as Susana Díaz, José Luis Rodríguez Zapatero, or Felipe González, but not that of Andalusian Juan Espadas, who alludes to the PSOE’s code of ethics.
