The judge sends the driver who killed the cyclists to prison for “his contempt for the lives of others” – El Periódico

It accuses him of a crime of reckless driving, two against life, four against life in an attempted degree and another one of driving without a license The head judge of court number 5 of Rubí (Vallès Occidental) has ordered this afternoon provisional prison for driver who was arrested last Sunday the 21st as the alleged perpetrator of the multiple hit by eight cyclists in Castellbisbal, two of whom died and a third remains in critical condition. Specifically, the judge accuses him of a crime of reckless driving, two crimes against life, four more crimes against life in an attempted degree and another one of driving without a license. In a forceful prison order, the togada underlines that the investigation by the Mossos d’Esquadra concludes that the detainee rammed the victims “infringing the basic rules of circulation.” According to the statement, he was driving “at a higher speed than expected for this type of road, with obvious symptoms of being under the influence of drugs and without a driving license.” And, “for no apparent reason”, he invaded the opposite lane, where cyclists were circulating, despite the fact that it is a section where overtaking is prohibited. The judge also highlights that after having collided, and of the “very serious results of his actions”, the driver “fled without being interested in the state of the injured and without helping them”. This gesture denotes, for the judge, the “absolute disregard for the norm as well as for the life and integrity of others” of the arrested person: “he left the scene of the accident with knowledge of the very high probability of having killed one of the cyclists”. As if the foregoing were not enough, the letter also underlines that this suspect, who has admitted to being the driver of the damaged vehicle and on which multiple indications such as security cameras or testimonies weigh, was circulating on Sunday ignoring two traffic convictions that They forbid you to take the car. For the above reasons, in addition to the risk of escape that the judge also appreciates in this case, the prison order maintains that to avoid the repetition of the crime, and keep it away from the road, preventive detention is the appropriate measure. I argue by emphasizing that it has been shown that the traffic penalties that deter other drivers do not work with him because he has continued driving. And that he does not drive again is essential since doing so puts the integrity of other people at risk. Preventive detention The detainee, a 41-year-old man, a resident of Martorell and with a criminal record, spent two nights at the Rubí police station and this Tuesday he was taken to court after 1:00 p.m. After taking his statement, the Rubí judge has sent him to jail without bail until the trial that awaits him for killing two cyclists, leaving a third in critical condition and injuring two others. Related news From the dock, he must also explain why, after running over the group of eight cyclists, he fled without helping the victims or calling the emergency services to attend to them. It was not possible to find him until almost twelve hours later, when the Mossos arrested them in Martorell, after the car he was driving was found in that town with its front windows smashed. This is one of the most serious accidents in which cyclists have been involved in Catalonia. It happened shortly before 11:00 am on Sunday the 21st on the C-243c, at kilometer point 0.5, at Castellbisbal. Two men aged 66 and 72 and neighbors of Rubí died. A third remains in critical condition at the Bellvitge hospital.
